Terms of service

These terms are the agreement between you and Eggsports ("we", "us") for using the website at eggsports.org and the Eggsports app for iPhone and Android. We've written them in plain language. By using the website or the app, you agree to them. If you don't agree, please don't use Eggsports.

Our privacy policy explains how we handle your data. Please read it alongside these terms.

Wellness, not medical advice

Eggsports is a wellness and mindful movement companion. It doesn't diagnose, treat or prevent any condition, and it isn't a contraception or fertility tool. Nothing on the website or in the app is medical advice, and none of it replaces care from a doctor, midwife or other health professional who knows your history.

Always talk to your doctor or midwife about exercise, especially during pregnancy and after giving birth. In the app, movement during pregnancy and after birth only opens once you confirm that a professional has cleared you to exercise. Please only confirm this when it's true.

During pregnancy and after birth, stop exercising and get help if you notice any of these warning signs:

You know your body best. Every movement is optional, rest is always a valid choice, and you should stop anything that doesn't feel right.

Who can use Eggsports

You must be at least 18 years old to use the app and to join the waitlist. The app asks you to confirm your age before you start.

Your account

• Starting out. The app creates an anonymous account for you, with no email or password, so you can start with taps alone.
• Linking. You can link your account to Sign in with Apple or Sign in with Google. Linking is optional, including when you buy a subscription.
• If you don't link. Your garden lives only with that anonymous account. If you lose your phone or delete the app before linking, we can't recover your garden. Your subscription, though, can still be restored through your store account.
• Keeping it safe. You're responsible for the security of your phone and of the Apple or Google account you link to.
• Leaving. You can delete your account at any time in the app, as described in our privacy policy.

Subscriptions and free trial

You can try Eggsports before paying: onboarding and your first check-in are free. After that, the daily check-in and practices need a subscription.

• Prices are in US dollars. Outside the US, the App Store and Google Play show the equivalent price in your local currency, including any taxes they apply.
• The free trial is run by Apple or Google. Each store decides who is eligible, usually one trial per store account. The trial converts automatically into a paid annual subscription unless you cancel at least 24 hours before it ends. Before your free week ends, the app reminds you of the date and the price.
• Renewal. Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. To avoid being charged for the next period, cancel at least 24 hours before it begins.
• Cancelling. You cancel in your App Store or Google Play subscription settings. The app's subscription screen links you there. Deleting the app or your Eggsports account doesn't cancel a subscription.
• Payment and refunds. Apple and Google take the payment, so refunds are handled by them under their own policies. To ask for a refund, contact Apple (reportaproblem.apple.com) or Google Play. Your statutory rights, including any right to withdraw from a purchase that applies where you live, aren't affected.
• Price changes. If the price of your subscription changes, your store will tell you beforehand, as its rules require.
• When a subscription ends. Your garden stays with you, read-only. The eggs and flowers you've grown aren't taken away because you stopped paying.

Founding-member offer

People who join the waitlist and confirm their email address get their first year of the annual plan for $29.99 instead of $39.99.

• We email each confirmed member one code, which can be used once.
• The code can be redeemed from launch day until 30 days after launch. After that it expires.
• On iPhone, you redeem it in the App Store or with the app's "Redeem code" button. On Android, you enter it in the app's "Redeem code" screen.
• After the first year, the subscription renews at the regular annual price unless you cancel.

Acceptable use

Please use Eggsports for what it's for: your own wellness. You agree not to:

• break the law, or use Eggsports to harm or harass anyone;
• get around the subscription, the safety rules, or any security measure;
• create accounts or join the waitlist automatically, or overload our services;
• copy, download or redistribute the exercise demonstrations, or reverse engineer the app, except where the law allows it;
• resell or sublicense Eggsports or its content;
• use a public garden link to mislead or harass anyone.

We may suspend or close an account that seriously or repeatedly breaks these terms. Unless the law prevents us, we'll tell you why.

Our content and the content of others

• Our content. The Eggsports name, the articles, the tools, the garden art, the app and the website design belong to Eggsports or to those who license them to us. You may read and use them for your own, personal purposes.
• Quoting us. You're welcome to share links to our pages and to quote short passages, as long as you name Eggsports and link to the page you quoted.
• Exercise demonstrations are licensed from third parties. You may watch them in the app and on the website, but not download, copy or share the videos.
• Your garden. Your check-ins and your garden are yours. If you choose to share a public garden, you allow us to display it at its link until you make it private again.
• Feedback. If you send us ideas or suggestions, we may use them freely, without any obligation to you.

Free tools

The free tools on eggsports.org are provided as they are, for information. They give estimates based on the research cited on each tool page, and they can't account for everything about you. They're not a diagnosis, they're not a medical device, and they must never be used for contraception or to plan or avoid a pregnancy. A due date or a cycle phase is always an estimate.

Availability and changes to Eggsports

We work to keep Eggsports available and accurate, but we can't promise it will always be uninterrupted or free of errors. We may change, add or remove features. If we make a change that significantly reduces what a paid subscription gives you, we'll tell you beforehand.

Our responsibility to you

Nothing in these terms limits or excludes any liability that can't be limited or excluded by law, including liability for death or personal injury caused by our negligence, or for fraud. Nothing in these terms takes away the rights you have as a consumer where you live.

Where the law allows:

• We're not responsible for losses we couldn't reasonably have foreseen, or for losses caused by your not following the safety guidance, warning signs or professional advice described above.
• Eggsports is for personal use. We're not responsible for any business losses.
• Our total liability to you for any claim related to Eggsports is limited to the amount you paid for your Eggsports subscription in the 12 months before the claim arose.

Apple and Google

If you use the app from the App Store or Google Play, these terms are between you and Eggsports, not Apple or Google. Apple and Google aren't responsible for the app or its content, or for maintenance, support or claims related to it. Their own terms also apply to your use of their stores, and you must follow them. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

When we change these terms, we update the date at the top of this page. If a change materially affects you, we'll tell you in the app, or by email if your account is linked, before it takes effect. If you don't agree with the new terms, you can stop using Eggsports and cancel your subscription at any time.

General

If any part of these terms turns out to be invalid, the rest still applies. If we don't enforce a part of these terms straight away, we can still enforce it later.
